This website is operated under the KYOJIN brand (“KYOJIN,” “we,” “us,” or “our”). KYOJIN provides this website, including its content, features, products, and services (collectively, the “Services”), subject to these Terms of Service (“Terms”).

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and Services to you.

These Terms apply to everyone who accesses or uses the Services, including visitors and customers.

By visiting kyojin.shop, placing an order, or otherwise using the Services, you agree to these Terms and the policies incorporated into them, including our Privacy Policy, Refund Policy, and Shipping Policy.

Please read these Terms carefully. If you do not agree, do not use the Services.

Nothing in these Terms limits any consumer right or remedy that cannot legally be limited or waived.

1. Eligibility and Accounts

You must be legally capable of entering into a binding purchase agreement in your jurisdiction to place an order.

You agree to provide accurate, current, and complete information when placing an order or creating an account.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

2. Products and Intended Use

KYOJIN offers clothing, accessories, masks, balaclavas, and other fashion products described on their applicable product pages.

Products should be used only for their intended purpose and according to any care, safety, sizing, or usage instructions provided with the product.

Unless expressly stated otherwise, KYOJIN masks, balaclavas, and face coverings are designed as fashion accessories and for general warmth or coverage. They are not medical devices, protective equipment, safety equipment, or substitutes for certified respiratory protection.

Product descriptions, photographs, videos, testimonials, styling examples, measurements, sizing information, and other content are provided to help customers evaluate our products. They do not guarantee that a product will fit or appear exactly the same on every person.

Customers are responsible for reviewing product descriptions, measurements, sizing information, materials, care instructions, and applicable warnings before purchasing or using a product.

Discontinue use if a product causes irritation, discomfort, restricted vision, difficulty breathing, or another adverse reaction.

Children should use masks, balaclavas, or face coverings only with appropriate adult supervision. Products should never be used in a way that obstructs breathing, creates a choking or entanglement risk, or interferes with safe vision.

3. Product Images, Materials, and Handmade Variations

We make reasonable efforts to display product colors, materials, textures, stitching, dimensions, proportions, graphics, and other details accurately.

Screen settings, lighting, photography, production methods, material sourcing, dye lots, and other factors may cause minor differences between images displayed online and the product you receive.

Some KYOJIN products are handmade. Minor variations in stitching, knit texture, shape, dimensions, color placement, and finishing may occur and form part of the individual character of a handmade product.

These natural variations are not generally considered defects unless they materially affect the product’s appearance, quality, durability, or intended use.

Product materials, packaging, design details, and presentation may be updated from time to time where permitted by law, provided that any substitution does not materially reduce the product’s overall quality or functionality.

Products are offered subject to availability.

4. Orders and Acceptance

Submitting an order constitutes an offer to purchase.

An order is accepted when we confirm acceptance through our checkout, order-confirmation, or shipment process.

We may refuse, limit, or cancel an order for legitimate reasons, including:

• suspected fraud;

• unauthorized resale;

• payment problems;

• inventory errors;

• pricing errors;

• abuse of promotions;

• unusual order activity; or

• violations of these Terms.

If we cancel an order after payment has been captured, the applicable amount will be refunded to the original payment method.

You are responsible for checking your shipping address, email address, selected products, sizes, colors, quantities, and payment information before completing checkout.

We cannot guarantee that an order can be changed or cancelled after processing or production has begun.

5. Personal Use and Resale

Products purchased through the Services are intended primarily for personal use unless we expressly agree otherwise.

You may not purchase KYOJIN products for unauthorized resale, redistribution, relabeling, export, marketplace resale, reproduction, or other commercial exploitation without our written authorization.

We may limit quantities or cancel orders where we reasonably believe products are being purchased for unauthorized resale.

6. Prices, Taxes, and Payment

Prices, promotions, shipping charges, discounts, and product availability may change before an order is placed.

The price and currency displayed at checkout apply to the transaction, subject to correction of obvious errors and applicable law.

Applicable taxes, shipping costs, duties, customs charges, and other required fees will be displayed or disclosed when reasonably possible.

You authorize KYOJIN and our payment-processing providers to charge the payment method submitted at checkout for your order and any disclosed taxes, shipping costs, or other charges.

You represent that you are authorized to use the payment method provided.

Complete payment-card information is generally handled by Shopify and/or our payment-processing providers rather than stored directly by KYOJIN.

7. Shipping and Delivery

Shipping methods, destinations, estimated processing times, delivery estimates, and applicable charges are described through checkout and our Shipping Policy.

Delivery dates are estimates unless expressly stated otherwise.

Handmade or made-to-order products may require additional production time before shipment. Any production or processing estimate displayed on the applicable product page forms part of the estimated fulfillment timeline.

Carrier delays, customs processing, weather, high order volumes, inaccurate addresses, service interruptions, and circumstances outside our reasonable control may affect delivery.

You are responsible for providing a complete and accurate shipping address.

Any remedy will be handled according to our Shipping Policy, Refund Policy, and applicable law.

8. Returns, Refunds, and Guarantees

Returns, refunds, exchanges, damaged items, cancellations, and other refund matters are governed by our Refund Policy.

For hygiene and safety reasons, masks, balaclavas, face coverings, and similar products may be subject to return restrictions after they have been worn, used, washed, or removed from sealed protective packaging.

Any money-back guarantee, satisfaction guarantee, promotional refund promise, or similar offer displayed on the Site is subject to the terms presented with that offer and our Refund Policy.

If a product page or checkout provides specific guarantee terms, those specific terms apply to that purchase.

Nothing in these Terms limits rights relating to defective, unsafe, misdescribed, or non-conforming goods that cannot legally be excluded.

9. Bundles, Free Products, and Promotions

We may offer bundles, gifts with purchase, “buy more, save more” promotions, free products, discount codes, or other promotional offers.

Promotions may have eligibility requirements, quantity requirements, expiration dates, purchase limits, or other conditions.

For example, a Buy 2, Get 1 Free offer requires the qualifying purchase described in the offer to receive the additional product.

Unless expressly stated otherwise:

• promotions cannot be combined;

• discounts cannot be redeemed for cash;

• offers cannot be applied retroactively;

• free products have no separate cash value; and

• promotional availability may be limited.

We may correct or cancel promotions affected by fraud, abuse, technical errors, or material pricing errors, subject to applicable law.

Returns involving promotional bundles or free products will be handled according to our Refund Policy.

10. Intellectual Property

The Services and their content—including the KYOJIN name, logos, product names, garment designs, mask designs, patterns, graphics, photographs, videos, text, advertisements, icons, page layouts, trademarks, and software—are owned by or licensed to KYOJIN and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal shopping and informational purposes.

Without our permission, you may not reproduce, copy, modify, scrape, republish, sell, distribute, manufacture, create derivative works from, or commercially exploit protected KYOJIN materials except where applicable law expressly permits it.

Purchasing a KYOJIN product does not transfer any intellectual-property right in the product’s design, branding, artwork, patterns, photographs, or related materials.

11. Reviews, Testimonials, and User Content

If you submit a review, photograph, video, testimonial, comment, idea, or other material (“User Content”), the content must be truthful and must reflect your genuine experience when presented as a testimonial.

User Content may not be unlawful, misleading, fraudulent, infringing, abusive, defamatory, obscene, deceptive, or otherwise inappropriate.

If you received compensation, free products, discounts, employment, or another material benefit connected to a testimonial, you must make any disclosure required by applicable law.

You retain ownership of your User Content.

By submitting User Content to KYOJIN or requesting that we feature content in which you tag or mention KYOJIN, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to reproduce, host, adapt for formatting, publish, display, distribute, and use that content in connection with the Services and KYOJIN marketing, subject to applicable law.

You represent that you have the rights and permissions necessary to grant this license, including permission from any identifiable person appearing in the User Content.

We may remove content that violates these Terms, infringes another person’s rights, exposes private information, constitutes spam, or creates legal or security risks.

We do not require positive reviews in exchange for compensation and do not knowingly present fake reviews as genuine customer experiences.

12. Third-Party Services

The Services may use third-party providers, including:

• Shopify;

• payment processors;

• shipping and fulfillment providers;

• analytics providers;

• marketing platforms;

• social-media platforms;

• customer-support tools; and

• other technology providers.

We make reasonable efforts to keep product information, sizing, materials, pricing, promotions, shipping information, and availability accurate.

Occasional errors, inaccuracies, or omissions may occur.

We may correct errors, update information, or modify the Services.

If a material correction affects an accepted order, we will provide any notice, choice, or remedy required by applicable law.

16. Availability of the Services

We may modify, suspend, update, or discontinue all or part of the Services for maintenance, security, operational, technological, legal, or business reasons.

We do not guarantee that the Site will always be available without interruption.

17. Disclaimer of Warranties

Except for express promises made by KYOJIN and warranties that cannot legally be excluded, we disclaim implied warranties to the maximum extent permitted by law.

Nothing in these Terms limits statutory warranties, consumer guarantees, product-liability rights, or other protections that cannot legally be waived.

18. Limitation of Liability

To the fullest extent permitted by law, KYOJIN and its owners, affiliates, employees, contractors, service providers, licensors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, revenue, data, savings, or business opportunities arising from the Services.

Where liability may lawfully be limited, KYOJIN’s total liability relating to a particular purchase will not exceed the amount you paid for the product or order giving rise to the claim.

These limitations do not apply where applicable law prohibits limitation, including certain claims involving fraud, willful misconduct, gross negligence, personal injury, defective products, or mandatory consumer protections.

Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless KYOJIN and its affiliates, personnel, and service providers from third-party claims, losses, liabilities, and reasonable costs resulting directly from:

• your unlawful use of the Services;

• your material breach of these Terms; or

• your infringement of another person’s legal rights.

This obligation does not require you to indemnify any party for its own unlawful conduct, negligence, or willful misconduct where prohibited by law.

20. Suspension and Termination

You may stop using the Services at any time.

We may suspend or terminate access where we reasonably believe you have materially violated these Terms, engaged in fraud or abuse, created a security risk, or used the Services unlawfully.

Termination does not affect rights or obligations that arose before termination.

Provisions that by their nature should survive termination will continue to apply.

These Terms are governed and interpreted according to applicable law, without limiting any mandatory consumer protection that applies where you live.

• regulatory requirements; or

• our service providers.

Changes apply prospectively unless applicable law requires otherwise.

23. General Terms

These Terms, together with the policies incorporated into them, form the agreement governing your use of the Services.

If product-specific or promotion-specific terms are presented at the time of purchase, those specific terms control for that product or promotion where they conflict with these general Terms, unless applicable law requires otherwise.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

Our failure to enforce a provision is not a waiver of that provision.
